You can join us for a day of workshops, jump on day 1 or day 2 of the conference, or be a part of the Norwegian or Swedish day. You have the opportunity to seize exactly the things that you want to learn more about.
We hope to see as many as possible in Copenhagen for Nordic Public procurement Forum. But if you are unable to meet with us, then the workshop on Framework Agreements and two main conference days will also be available for you to attend online. – the Opaque Interplay Between Public Procurement and National Contract Laws While the process of concluding public contracts is relatively harmonised thanks to the EU Public Procurement Directives, the laws ruling the awarded public contracts vary depending on where in Europe we are. In Nordics, public contracts are largely treated as any other private commercial contract to which national contract law is applicable. However, certain principles of contract law do not apply or have limited application to public contracts. For example, even if both contracting parties agree, they cannot modify the contract in a manner that would contradict the national equivalent of Article 72 Directive 2014/24/EU. Within this panel, we will have a roundtable discussion on the fundamentals of public procurement and contract law tensions, placing it in the context of contemporary challenges’ impacts on public contracts. We will share our views on the recent developments in Swedish case law and the possibility of applying the hardship clause to public contracts. The panel is organized under Research Project “Purchase Power – Sustainable Public Procurement through Private Law Enforcement“, carried out at the University of Copenhagen.

This book, The Fundamentals of EU Procurement Law: Towards Coherent Foundations, is targeted for publication in 2024 by Cambridge University Press. In it the authors identify and explore several key related themes which they argue contribute to difficulties in developing the EU procurement rules and applying them in practice and make some proposals to place the regime on a sounder conceptual footing for the future.

The presentation with focus on the specificities of ESA’s procurement framework. ESA as an international organization, is not subject to the provisions of the EU Procurement Directives, to the national procurement framework of its Member States, or to the Agreement on Government Procurement of the World Trade Organisation. As such, ESA has put in place a specific procurement framework, based on the principle that all member States participate in an equitable manner, having regard to their financial contribution, in implementing the European space programme and in the associated development of space technology. Another specificity of ESA’s procurement framework is the three-tier review system to address claims by economic operators: a first claim for reconsideration of the decision by the Agency, a second claim to the Industrial Ombudsman, and a final claim for review by the Agency’s Procurement Review Board.
