The European Commission has updated EU AI model contractual clauses produced by the community to align with the EU AI Act. The new version includes a full high-risk AI version, a customisable light version and a detailed commentary. Public authorities procuring AI solutions are encouraged to explore the updates and share their feedback.
On 13 June 2024, the EU adopted the Artificial Intelligence Act (EU AI Act), making it the first-ever global law to regulate the use of AI in a broad and horizontal manner. The historic measure applies to the development, deployment and use of AI in the EU. The EU AI Act entered into force on 1 August 2024, but its provisions will start applying gradually, starting from 2025.
To support responsible AI procurement, the Community of Practice previously published EU model contractual clauses, which were made available on 29 September 2023. These clauses, peer reviewed by experts, included both a high-risk and non-high-risk version, translated into all EU languages.
The Community of Practice has now released an updated version of these clauses. In addition, a Commentary to the clauses clarifies how the clauses can be used in practice. This version of the clauses will be translated into all EU languages and the translations will be added to this resource once they are ready.
