The Regulation provides the framework to set minimum product-specific mandatory green public procurement criteria at EU level.
The ESPR entered into force on 18 July 2024. It establishes a framework for setting ecodesign requirements on specific product groups. It enables the setting of performance and information conditions – known as ‘ecodesign requirements’ – for almost all categories of physical goods (with some exceptions, such as food and feed, as defined in Regulation 178/2002).
The ESPR enables the Commission to adopt implementing acts setting minimum mandatory Green Public Procurement requirements for public buyers for the products it regulates. This has the potential to significantly boost demand for sustainable products and further incentivise companies to invest in such products. The ESPR is a framework legislation, meaning concrete product rules and GPP requirements will be adopted progressively over time, on a product-by-product basis, or horizontally, on the basis of groups of products with similar characteristics. The GPP requirements may take the form of technical specifications, award criteria, contract performance conditions or targets.
