Sue Arrowsmith announces her awards for “best” (and “worst”) ECJ PP judgments of the last two decades at NPP ’25

Let’s be honest: who doesn’t love an award show? Especially when it’s a well-argued appraisal (and roast!) of EU Court of Justice (ECJ) Public Procurement judgments from the past two decades — with the esteemed Professor Sue Arrowsmith KC (Hon) at the helm! For several years, Professor Emerita Sue Arrowsmith, University of Nottingham (UK), has reviewed recent ECJ Public Procurement case law at Nohrcon’s annual Public Procurement conference – and this year is no different when she enters the stage in Copenhagen on Main Conference Day 2, 20 November:

Keynote presentation: New procurement case law from the Court of Justice

As every year, Professor Sue Arrowsmith will provide an analysis of the procurement cases of the EU Court of Justice from the last twelve months. As this year has produced some interesting and – in her view – rather questionable judgments, the analysis will be spread over two sessions to do the topics full justice.

Topics to be covered will probably include (but depending, as always, on what new interesting cases might come along before November!):

Modifications to concluded contracts
Transparency and the need for clarity in national law
“Self-cleaning” measures to avoid exclusion
The rights of third country suppliers
Use of the negotiated procedure without prior publication
Technical specifications
